Responsibilities of the HR Practitioners
Listed below are the key responsibilities of HR Practitioners in relation to the above sponsorship undertakings.
Prior to commencement of employment
- Ensure visa requirements are detailed in the offer of employment
- Ensure visa sponsorship details are recorded in the visa data panels in the Human Resource Management System (HRMS) and placed on the personal file
- Ensure details of the visa (once it has been granted) are recorded in visa data panels in the HRMS and a copy of the visa is placed on the personal file
- Ensure the dates of the visa are consistent with the employment period
- Ensure the sponsored employee has private medical insurance for the duration of the visa.
During the period of employment
- Notify DIAC of any change of circumstances during the employment period by emailing e457.sydney@immi.gov.au
At the cessation of employment
- Enter a termination row in the HRMS as soon as a resignation has been received or a termination date has been confirmed
- Advise the appropriate Recruitment and Appointments member via email ASAP of any cessation of any staff member who is holding a visa sponsored by the University (The University must notify DIAC of the cessation within ten working days)
Transition to permanent residence
A streamlined pathway to permanent residence -' the Temporary Residence Transition Stream' - is available to subclass 457 visa holders who have worked for the ANU for the last two years and the employer wants to offer them a permanent position in that occupation immediately preceding their ENS or RSMS application.
The position will need to meet the following criteria:
- the job or position being nominated for permanent residence is consistent with the position the person held while on their subclass 457 visa (same as ANZSCO code)
- the position will continue to be available to the prospective migrant for at least two years
- the terms and conditions of employment are the same as any that would apply to an Australian citizen
- the prospective migrant will be paid the -'market rate'. That is, the nominee will be paid at least as much as an Australian employed in the same position in the same location
- the employer has met the subclass 457 training requirement. The visa applicant will need to meet the following criteria:
- being less than 50 years of age, unless they are exempt
- have English language proficiency of at least five in each of the four components of the International English Language Test Score (IELTS) test, unless they are exempt.
These visa applicants will not need to have their skills and qualifications assessed for the permanent visa because of their prior employment and continuing employer sponsorship.
